Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and ParkBuds ("ParkBuds", "we", "us") governing your access to and use of the ParkBuds mobile application and any related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

2. Eligibility

• You must be at least 17 years old to create an account and use the Service.
• You must have the legal capacity to enter into these Terms in your country of residence.
• You may not use the Service if you are barred from doing so under applicable law, or if your account has previously been suspended or terminated by us.

3. Your account

• Provide accurate information when you sign up and keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for everything that happens under your account.
• Notify us promptly at hello@parkbuds.app if you suspect unauthorized access.
• One account per person. Do not impersonate another person or misrepresent your affiliation.

4. Acceptable use

When using ParkBuds, you agree not to:

• Harass, stalk, threaten, bully, or intimidate any other user.
• Post content that is hateful, sexually explicit, violent, discriminatory, or that exploits minors.
• Solicit sexual contact, use the Service for dating or hook-ups, or send unwanted sexual content.
• Post false, misleading, deceptive, or fraudulent content, including fake meet-ups.
• Spam, scrape, reverse engineer, decompile, or circumvent the Service.
• Sell, advertise, or promote commercial products or services without our written permission.
• Use the Service to plan or commit anything illegal.
• Disclose another user’s personal information without consent.
• Record, photograph, or livestream another user without their consent.
• Attempt to access accounts, data, or areas of the Service you are not authorized to use.

We may remove content and suspend or terminate accounts that violate this section.

5. Meet-ups and real-world safety

• ParkBuds does not perform background checks on users.
• ParkBuds is not a party to, and is not responsible for, interactions or arrangements between users.
• You are solely responsible for your decision to meet any other user and for your conduct during any meeting.
• In an emergency, call your local emergency services.

6. Your content

You retain ownership of the content you post to ParkBuds ("User Content"). By posting User Content you grant ParkBuds a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, and display that content for the purpose of operating, improving, and promoting the Service. This license ends when you delete the content, except for (a) copies we are legally required to retain and (b) content other users have reshared.

You represent and warrant that you have all necessary rights to the User Content you post and that it does not violate anyone else’s rights or any law.

7. Reporting and moderation

Use the in-app report and block tools to flag objectionable content or users. We review reports and take action we consider appropriate, which may include removing content, issuing warnings, or suspending or terminating accounts. We do not guarantee any specific moderation outcome or response time.

8. Third-party services

The Service integrates with third-party platforms (for example, Apple, Google, Supabase, Expo, Google Maps). Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for third-party services or their content.

9. Feedback

If you send us feedback, suggestions, or ideas about the Service, you grant ParkBuds a perpetual, irrevocable, royalty-free license to use that feedback without obligation to you.

10. Intellectual property

The Service, including the ParkBuds name, logo, and software, is owned by ParkBuds and is protected by copyright, trademark, and other laws. Except for the rights explicitly granted in these Terms, we reserve all rights. You may not use our trademarks without our prior written permission.

11. Termination

• You may stop using the Service and delete your account at any time from Profile → Delete account.
• We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or created risk or possible legal exposure for us or other users.
• Sections intended to survive termination (including content license granted to us, disclaimers, limitations of liability, indemnification, and governing law) survive termination.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKBUDS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, OR THAT CONTENT WILL BE ACCURATE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKBUDS AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO US $100.

14. Indemnification

You agree to indemnify and hold harmless ParkBuds and its officers, employees, agents, and affiliates from any claim, liability, loss, or expense (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) your User Content, (c) your interactions with other users, or (d) your violation of these Terms or any law.

15. Governing law and disputes

These Terms are governed by the laws of the State of [YOUR STATE], United States, without regard to its conflict of law rules. You and ParkBuds agree to resolve any dispute arising out of or relating to these Terms or the Service exclusively in the state or federal courts located in [YOUR COUNTY], [YOUR STATE], and you and ParkBuds consent to personal jurisdiction there.

If you are a consumer resident in the European Economic Area, the United Kingdom, or Switzerland, you may also bring a dispute in the courts of the country where you live, and mandatory consumer protections in your country will apply.

16. Apple App Store and Google Play

• These Terms are between you and ParkBuds only, not with Apple or Google.
• Apple and Google are not responsible for the Service or support related to it.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms of agreement (for example, your wireless service plan) when using the Service.

17. Changes to these Terms

We may modify these Terms from time to time. If we make material changes, we will notify you in the app or by email and update the "Last updated" date above. If you continue to use the Service after the change takes effect, you accept the revised Terms. If you do not accept them, stop using the Service and delete your account.

18. Miscellaneous

• Entire agreement: these Terms and our Privacy Policy are the entire agreement between you and ParkBuds regarding the Service.
• Severability: if any provision is unenforceable, the rest remains in effect.
• No waiver: failure to enforce a provision is not a waiver.
• Assignment: you may not assign these Terms without our consent; we may assign them to an affiliate or successor.
